The following are examples of cases that we have had the privilege of representing the injured victim. The facts below are very summary and provided more as an example of the type of cases handled by this law firm over recent years. Psychiatric injury. Client involved in a significant rear-end collision with a commercial vehicle but escaped with physical injuries that were reported to have healed within six months of the accident, but continued with psychiatric emotional suffering. A prior history of depression that had been treated allowing the patient to be successfully employed and fully functional in both her average daily living and occupational activities was set backwards by the emotional trauma caused by the accident. Recovery in January 2010 in the amount of $130,000.00.
Contractor worker fell 40 feet into a pit, sustaining life-threatening injuries. Liability hotly contested. We argued general contractor gave training to employees, which it failed to give contracted workers and that it failed to properly mark the pit area. Recovery in October of 2008 for $850,000.00.
Amputation injury to arm/Product defect: A conveyor belt was not properly guarded, but the injury was compounded when the machinery could not be shut off due to an error in programming the computer system. Suit against conveyor manufacturer and computer programmer. Recovery in July, 2006 for $1,300,000.00
Trucking accident/Amputation injury foot: during delivery, trucker is struck by a forklift as he walks around his cab. His foot is amputated. Significant dispute over whether client, the truck driver, stepped in front of the forklift so defendant's forklift driver could not avoid him. Recovery in November, 2005 for $975,000.00
Van lost control on icy roadway, crossing over into truck hauling cattle. Client underwent back surgery. Recovery in September, 2007 for $700,000.00
Young boy received brain damage while down behind parked vehicle, driver was unaware that he was not in vehicle, and backed up. Recovery in December, 2005 for $550,000.00
Driver pulled in front of plaintiff due to sun in his eyes. Plaintiff had preexisting neck fusion and rotator cuff repair. Accident caused pain in good shoulder and aggravated neck. Recovery in February, 2004 for $450,000.00
Stone mason injured when fork lift driver released stone onto which stonemason was holding. Recovery in October 2002 for $450,000.00
Defendant rear ended plaintiff after drinking excessively at two taverns. Recovery against the taverns and drunk driver: Recovery in April, 2008 for $440,000.00
Phantom vehicle that failed to stop and identify itself after it ran truck off roadway, rolling off embankment. Uninsured policy recovery in February, 2005 for $275,000.00
Office worker looses balance, leans on handrail that comes loose from the wall causing him to fall. Back surgery twice but returns to higher paying employment after surgery. Defendant alleges rail installed properly, and manufacturer, also sued, alleges no defect. Recovery in September, 2008 for $207,000.00
Sheet metal worker was injured at the job site when he was directed to stand on the job shack, which collapsed due to the weight of the workers injuring his arm. Recovery in February 2003 for $100,000.00
Construction injury/workers falls fracturing face: Female employee of a subcontractor goes to the patio to throw trash to ground below, trips and falls to the ground, fracturing her face. The general contractor had failed to place a proper barrier or handrail around the patio, it denied it knew that workers would be outside of the building on the patio. Recovery in May, 2000 for $400,000.00
Negligent administration of governmental duty and denial of civil rights of minor. Minor groomed by sex offender into consenting sexual relationship, parole officer and agency sued for failure to act upon parents call for intervention before statutory rape. Recovery in April, 2004 for $70,000.00.
Allstate Insurance wrongfully evaluates a claim: Soft tissue injury to elderly woman. We offered to settle for policy limits of $50,000. Allstate refused. The case was tried with the jury finding the defendant liable and awarded $136,000. Allstate Insurance Company appealed to the Supreme Court of Washington, the court required the case to be retried on liability, but not damages. The jury award for damages was affirmed. Ultimately Allstate paid the damage award, attorney fees and costs associated with appeals, after it appealed following the second trial on liability. Total paid by Allstate: $212,029.00 in March 2005
Allstate Insurance Company denied liability for its insured failing to stop at a stop sign at a T- intersection, alleging stop ahead lights not working. Client underwent two shoulder surgeries but returned to better paying job. Ellensburg jury. Recovery in February, 2008 for $123,000.00.
Wrongful death/denial of civil rights. Our client was properly arrested, but when arrested she was in possession of several balloons full of cocaine. In a moment of panic, she swallowed the balloons. One or more broke inside her stomach. The arresting authorities saw she was acting abnormal with dilated pupils, locked her in a holding room, and failed to monitor her throughout the evening. The next morning she was dead, and our toxicologist confirmed death more likely than not would have been avoided had she received care. She was not regularly employed. Recovery in August 2002 for $225,000.00
Tossing limbs into county garbage bin not protect with fall protection as available elsewhere in Washington counties, when he lost his footing and fell down into the bin breaking his ankle. Recovery in March, 2006 for $140,000.00
Client was snow skiing when hit from behind by a skier on a racing team, requiring shoulder surgery. Recovery in April 2003 for $200,000
Motorcycle lost control on a highway that was improperly signed during road construction. Shoulder surgery. Recovery in December, 2002 for $105,000.00
Multiple car accident in a dust storm, was rear ended by someone traveling approximately 50 mph. Recovery: $110,000.00
Client in the back of a pickup coming down a mountain road. She hollered for the driver to slow down, then they hit gravel and went off embankment. Recovery in September 2004 for $95,000.
Boat/wave runner, driver is alleged to hit dock causing passenger to fall, driver alleges passenger at fault. Surgery for to treat already existing disability, but full medical recovery by passenger, no impairment. Recovery in September, 2008 for $75,000.00
Boat operator tows skier too close to other boat, rope crosses other boat catching client's arm, shoulder surgery. Recovery in January 2008 for $42,000.00
Vehicle tire flew off after rotation of tires by Les Schwab Tires. Recovery in June, 2008 for $50,000.00
Elderly couple went to tavern regularly in the morning for coffee. She sat down on bar stool which collapsed, injuring her shoulder. Recovery in June, 2006 for $60,000.00
Couple shopping at store for office chair. Plaintiff sat down and chair flipped backwards, hitting his head and shoulders. Cause of injury was due to chair being put together backwards. Recovery in December, 2006 for $39,500.00
